Woman’s maintenance claim

SHILLONG: In a case of maintenance being denied to a woman separated from her husband, Justice SR Sen of the Meghalaya High Court has asked the judge of the district council to hear afresh the matter since the petitioner was not heard earlier.
The case was filed by one Protima Marbaniang of  Lawsohtun against her former husband Ionis Kharpuri, a resident of Shyiap.
According to the petitioner, her husband had deserted her and the children in 2002 without making any arrangement for their survival. In this context, the woman filed a petition before the first class magistrate of sub ordinate district council court, which, on February 19 this year passed an order allowing the interim maintenance of Rs 6000 per month to her.
Unhappy over this, the respondent (Kharpuri) filed a petition for recalling the order of the district council court issued on February 19.
Later, the trial court fixed the matter for hearing on April 12.
However, the trial court stayed the February 19 order during the hearing which was not attended by the petitioner.
Following this, the woman filed a petition in the High Court, which in the recent order said that the matter should be heard again by the judge of the district council court. While setting aside the order of April 12, the court said that the matter should be heard in the presence of both the parties on October 3.
