SHILLONG: Justice SR Sen on Friday directed senior counsel V.K Jindal, appearing for NEEPCO, to show cause as to why contempt proceedings should not be drawn against him for an unwarranted and undesirable behaviour towards the court.
Justice Sen in his order said when the court took up the next item for hearing, the senior counsel was pressing for vacating the stay but when this court refused, he started forcing the Court to withdraw the stay order and also made an “unwanted posture and gesture”.
“Further, when this Court asked him to sit down as the order had already been passed and was not inclined to vacate the stay order, he started showing his big red eyes to the court and also shouted to the court not to show the finger,” the order said. Justice Sen said the court has no intention to show finger to anybody and the members of the Bar knows that as far as possible this Court has always maintained good behaviour and good relation with all the members of the Bar.
According to the order, this behaviour of the senior counsel was unwanted and intolerable and it amounted to contempt.
Earlier while hearing a matter of Arup Kumar Sarmah and NEEPCO, the court said neither anyone appeared on behalf of the petitioner nor anyone filed the rejoinder affidavit till passing of this order.
Jindal, assisted by M.K Marak on behalf of the respondents, pressed for vacating the interim stay and prayed that the matter may be posted for hearing after winter vacation.
Since the petitioner’s counsel was not present, the court did not find it proper to withdraw the stay order without hearing him and ordered that the stay order should continue till the next date.
The matter has been listed for hearing after winter vacation and registry is directed to send the copy of this order immediately to Jindal to showcause on or before December 23 as vacation Court will sit.
