SHILLONG: UDP MDC HS Shylla has asked people to take note that no state department should insist for any certificate from MUDA.
Addressing a press conference here on Monday, Shylla said, “If the department insists for occupancy certificates from MUDA, then people should let us know. If the various departments insist on certificates from MUDA, it will signify that there is a complete breakdown of government machinery in the State.”
“If that is the case, we will convene a public meeting and write to the governor to invoke President’s Rule in the State,” he added. He added that he will write to all traditional heads to prevent MUDA officials from ‘pestering’ people and stop encroachment by the urban body.
He asserted that confusion prevailed over the final order of the Division Bench of the Meghalaya High Court on February 16, 2017 on the PIL filed by Tirot Sing Syiemlieh against the MUDA Public notice of November 5, 2015.
He said, “Even after 18 days of the final order, no order from the Executive Committee of KHADC was issued which prompted me to write an open letter to the Chief Minister.”
The Order of the High Court stated that the Court has not adjudicated “on the issues sought to be raised by KHADC and all such questions/issues shall remain open to be examined in the appropriate proceedings and in the appropriate forum.”
“The MUDA Building Bye Laws 2011 was framed as per the Section 74 of the Meghalaya Town and Country Planning Act, 1973 which was also published in the Meghalaya Gazette on July 21, 2011 through a notification on April 12, 2011,” he said.
Quoting the High Court order which stated that all questions/issues will remain open to be examined in the appropriate proceedings, he said, “We have to understand what the appropriate forum is in this case? The appropriate forum is for the KHADC and the state government to have dialogue to remove the confusion.”
However, he pointed out that the CEM and CM have personal issues between them and this has created difficulty for the public.
Shylla stated that he has sought the Chief Minister Mukul Sangma’s intervention to prevail over MUDA and restrain including MeECL and PHE, from illegally enforcing MUDA Building Bye Laws in the District Council areas.
