SHILLONG: Chief Election Commissioner, AK Joti has said the Election Commission was examining the matter related to disqualification of 17 parliamentary secretaries that Meghalaya Governor Ganga Prasad referred to the Commission.
Speaking to media persons here on Saturday, Joti said the matter was being examined legally and the Commission was taking inputs from the state government.
“We can’t divulge anything as of now but an appropriate decision will be taken,” he told reporters.
The High Court of Meghalaya had on November 9 declared the appointment of parliamentary secretaries illegal based on a PIL filed by Madal Sumer of Jowai, West Jaintia Hills and on the same day, all parliamentary secretaries had resigned from the posts.
Later, representation was submitted by Sumer, under Article 192 (1) of the
) Constitution, to the Governor on November 13.As per the Constitution, the Governor referred the matter to the Election Commission to determine whether the legislators were holding office of profit.
