SHILLONG: Outlawed militant outfit HNLC was named in an alleged land dispute case in which the respondents are yet to appear for hearing. The complainant has now filed a defamation suit against the twin respondents awaiting justice in a court of law.
According to the case, Poshly Siangshi, a local businessman of Wapung Skur Mawpynieng village in East Jaintia Hills district is being accused of threatening Deepa Nongkynrih and Robin Dkhar.
The complaint dates back to December 23, 2015, when an FIR was lodged at Laitumkhrah police station by Nongkynrih and Dkhar who alleged that Siangshi called them from his mobile on December 21, 2015, and threatened them and their family with dire consequences if they refused to give him a portion of their land, situated at Laitkor Kseh Bilat on the outskirts of the city, with a bond.
The police registered a regular case under Section 107, which deals with security for keeping peace in other cases.
The police, following an investigation into the matter, had submitted a final report after the High Court on May 16, 2016, directed the investigating officer (IO) to conduct a fresh inquiry and submit the report. The IO submitted the report on June 16, 2016, stating that at present there is no disturbance.
The High Court after the perusal of the case passed an order stating that the case appears to be civil in nature and it is evident from the report of the IO who stated that the parties had a family relation.
However, in absence of evidence to substantiate the fact as alleged by the duo who even alleged that the complainant had links with the outlawed HNLC but fail to prove so, the case was disposed of.
According to the case documents, Siangshai had asked the duo to prove their allegations against him which he claim to be false, malicious and concocted and even offered to apologise if they can prove the allegation.
However, Siangshai asserts that the accused have failed to prove so.
Further, it is alleged that the duo had taken their “false and baseless allegations” to social media, which was done with the knowledge and intention to defame him.
Siangshai claimed that the statement of allegation of the duo is not only defamatory but has also maligned his reputation. He also accused the duo of threatening him at Laitumkhrah police station when the case was sub-judice. He now claims an amount of Rs 70 lakh from Nongkynrih and Dkhar for losses in business as well as mental agony that he has suffered for so long.
Meanwhile, sources informed that the duo have not appeared on April 24 this year during a hearing into the case. The next date is on June 1.
