HC disposes of drug producers’ petition against govt tender

SHILLONG: The High Court of Meghalaya has said the aggrieved small scale drug manufacturers’ association can challenge the conclusion of the tendering process by the Director of Health Services, Meghalaya.
The court of Chief Justice Mohammad Yaqoob Mir, while disposing of the case, said, “In view of the later developments, the petition is rendered infructuous. However, it shall be open for the petitioners if aggrieved, to challenge the conclusion of the tendering process.”
The drug manufacturers had alleged irregularities and favouritism in the process of selection of suppliers and had challenged the tendering process initiated by the Director of Health Services. To the information of the petitioner, the finalisation of the tendering process has been delayed with some design.
Additional Attorney General for the respondents B Bhattacharjee submitted that the tendering process has been completed and letter of acceptance has been issued. In support of his submission, he produced a photocopy of the communication/order.
