SHILLONG: The High Court of Meghalaya has ordered the mother and father of a 5-month-old baby to be present with the infant on October 14 while hearing a case regarding the custody of the child.
The court order on Thursday followed the petition in which the mother sough the custody of the five-month breast feeding baby from the father. Further, the mother is the natural guardian of the child.
Due to differences between the mother (petitioner) and the father, the child had been taken away from the former.
This petition has been filed against Union of India and others under Article 226 of the Constitution of India seeking issuance of writ of habeas corpus for securing the liberty and protection of the baby by the mother of the infant. The court issued notice to the respondents, including the father of the child, who will have to be present along with the child on the next date.
