Two men get RI in separate POCSO cases

SHILLONG, Sep 25: The Special Judge (POCSO), East Khasi Hills, on Thursday convicted two men in separate cases of sexual offences under the Protection of Children from Sexual Offences (POCSO) Act and awarded them rigorous imprisonment.
In the first case, Orlykupar Nongbri was sentenced to five years’ rigorous imprisonment and fined Rs 20,000 for an offence under Section 10 of the POCSO Act. In default of payment, he will undergo an additional six months in prison. Nongbri was also sentenced to three years’ imprisonment and fined Rs 10,000 under Section 457 of the IPC.
Special Judge (POCSO) MK Lyngdoh noted that the sentencing considered both mitigating and aggravating circumstances. The convict, who was related to the survivor, was found guilty under Sections 9(m) and 9(n) of the POCSO Act for committing aggravated sexual assault. The judge directed that all sentences would run concurrently. The case was based on an FIR lodged by the survivor’s mother at Laban Police Station in 2013. Investigation was carried out by WPSI MM Momin, while Special Public Prosecutor Lum Hynniewta handled the prosecution.
In the second case, the same court convicted Kaspelling Mawkon in connection with Special POCSO C/No.09/2016, arising out of Sohra PS Case No. 28(10)2014. He was sentenced to 10 years’ rigorous imprisonment and fined Rs 50,000 for an offence under Section 6 of the POCSO Act. In default of payment, he will serve an additional six months’ imprisonment.
Mawkon was also sentenced to one year’s imprisonment under Section 506 (Part I) of the IPC. The case was investigated by WPSI MM Momin, currently posted in North Garo Hills district, and prosecuted by Special Public Prosecutor Eva Rynjah.
