SHILLONG, Oct 29: The Court of Special Judge (POCSO), East Khasi Hills, MK Lyngdoh, on Wednesday convicted Banaiborlang Mawa and sentenced him to five years’ imprisonment along with a fine of Rs 20,000 for an offence under Section 8 of the POCSO Act. The case dates back to 2013.
In default of payment, he will undergo an additional six months of imprisonment. The accused was also sentenced to six months’ imprisonment for an offence punishable under Section 342 IPC. All the sentences shall run concurrently, the order stated.
The court, keeping in mind the social background of the survivor, the adverse psychological impact, physical harm, and mental trauma that the minor survivor suffered due to the crime, recommended compensation of Rs 2 lakh to be paid to the minor survivor by the Meghalaya State Legal Services Authority, Shillong.
The survivor was a neighbour of the convict and was 12 years and 2 months old at the time of the incident. The FIR was filed at Sohra Police Station.
The investigation was carried out by WPSI M.M. Momin, while Special Public Prosecutor Eva Rynjah conducted the prosecution.
