SHILLONG, Dec 17: The High Court of Meghalaya on Wednesday disposed of a PIL with direction to the GHADC to appoint a competent person as Judge of the District Council Court.
The applicant (Sam Ricardo R. Marak) was the Secretary-cum-Additional Judge, District Council Court of GHADC and had filed the application for modification of an earlier court order which had directed separation of the Executive from Judiciary and also further directed that the applicant shall continue to function as Additional Judge of the District Council Court.
Senior counsel for the applicant, S. Sen, submitted that the applicant is not competent to discharge his function as Additional Judge.
“It is for the District Council to decide on the issue. It is expected that a competent person shall be appointed as Judge of the District Council Court,” the court said while disposing of the application.
