SHILLONG: The High Court of Meghalaya on Tuesday quashed the ‘one-sided’ inquiry report on the complaint filed by Mendipathar MLA Marthon Sangma in 2014 against former legislator Frankenstein W. Momin for issuing utilisation certificates (UCs) for MLA scheme even after demitting office.
The court ordered fresh inquiry into the matter as the statement of the Mendipathar MLA, who was the complainant, was not taken.
Earlier in September last year, the Court had directed North Garo Hills Deputy Commissioner Sibhi Chakravarthy Sadhu to dispose of Sangma’s petition within 15 days.
Sangma had sought the Court’s intervention after the deputy commissioner delayed in taking action.
The complaint of Sangma addressed to the deputy commissioner on June 30, 2014, was that Saljong Marak, Block Development Officer, Resubelpara, had fraudulently released the entire second installment under the Special Rural Works Programme (SRWP), 2012-13, amounting to Rs 11.75 lakh for the work not done on the basis of the UCs issued by ex-MLA Momin.
Following the direction of the Court, the deputy commissioner had entrusted the matter to be probed by BDO C.N Sangma.
The probe conducted without getting the views of Marthon Sangma gave clean chit to the then BDO of Resubelpara, Saljong Marak.
The lawyer for the MLA, Sujit Dey, said aggrieved over the matter as it was a one-sided inquiry, a writ petition was filed in the Court.
When the matter came up for hearing on Tuesday, Judge S.R Sen set aside the report of the inquiry committee by the BDO and asked him to complete a fresh probe within 15 days.
