HC bars state to set up new weighbridges

SHILLONG: The High Court of Meghalaya on Monday barred the state government from setting up new weighbridges or issuing tender for new weighbridges and instead directed that it complies with the Supreme Court order for setting up integrated check-gates.
The bench, comprising Chief Justice Mohammad Yaqoob Mir and Justice SR Sen, while hearing the petition filed by Gavin M Mylliem, said keeping in mind the apex court order of November 6, tendering process should be closed till the time it is decided how many integrated check-posts are to be set up.
The order of the Apex Court had said, “ We direct that till the requisite number of integrated check-posts are set up as per the existing policy of the State, the existing weighbridges, whether private or Government, shall not be discontinued”.
During the hearing of the matter in the High Court, the Government Advocate submitted that the State  is likely to formulate a policy and to take decision for setting up integrated check-posts.
“As and when such decision is taken consistent with the existing policy, if any, or policy in formulated for setting up integrated check-posts, only then it shall be open for the respondents to initiate the tender process. As on date, in absence of any policy decision and decision as to how many integrated check-post are to be setup, the tender notices as issued are unsustainable”, he court said .
