HC summons ADC for domicile certificate delay

SHILLONG: The High Court of Meghalaya has summoned I Majaw, Additional Deputy Commissioner of East Khasi Hills, to appear before the court on Tuesday for the delay in providing domicile certificate to a resident.
The High Court also directed the deputy commissioner or the additional deputy commissioner to issue the domicile certificate to the applicant on Monday itself.
The petitioner, Amon Rana, through his lawyer R Gurung, submitted that in spite of submitting all the documents, the additional deputy commissioner did not issue the domicile certificate for the last 10 months and most of the time she was not available in the office room, “which is really hurting and undesirable”.
Justice SR Sen, while hearing the matter, referred to the earlier order of the court.
The earlier order had said whenever anybody applies for a domicile certificate, the deputy commissioner and the superintendent of police concerned were directed to see that “it should be hassle free and not make the applicant run like a beggar”.
According to the order, the superintendent of police should complete his report within three days from the date of requisition and thereafter the deputy commissioner’s office will have to grant the domicile certificate within three days, which means that the entire exercise should be completed within one week.
“If there is any violation, it will amount to contempt of court. However, if the applicant has any criminal background, domicile certificate shall be rejected subject to the final order of the criminal court,” the order had said.
