HC dismisses criminal appeal by rape convict

SHILLONG, Feb 26: The High Court of Meghalaya on Monday dismissed a criminal appeal against a judgment whereby the accused in a POCSO case was convicted and awarded a sentence of three years of rigorous imprisonment and a fine of Rs 5,000, besides simple imprisonment of a month in default.
The judgment was passed by the Special Judge (POCSO), West Jaintia Hills District, Jowai, in Special Sessions (POCSO) case.
An FIR (dated December 15, 2021) was lodged by the complainant-cum-survivor before the Officer-in-Charge of Mukatapur Police Patrolling Party (Muktapur PPP) alleging that on December 15, 2021, around 11 am, the appellant, Sai Suchen, had attempted to rape her at her resident in Lumpyngngad village.
The said FIR was received by the Muktapur PPP the next day. Thereafter, it was forwarded to Dawki Police Station. A cognizable case under Section 7/8 of POCSO Act was registered.
Upon completion of the investigation, a charge-sheet was filed against Suchen.
The high Court, after hearing the appellant and the respondent, observed that there is no merit in this appeal and dismissed the same.
