HC orders immediate separation of powers in GHADC

SHILLONG, Dec 10: The High Court of Meghalaya has directed that S.R.R. Marak, Additional Judge of the District Council Court, must immediately cease functioning as Secretary to the Executive Committee of the GHADC.
The ruling came from a Division Bench of Chief Justice Soumen Sen and Justice Hamarsan Singh Thangkhiew while hearing a Public Interest Litigation (PIL) that highlighted a serious violation of the principle of separation of powers.
The petitioner (Flaming B. Marak) obtained RTI documents revealing that S.R.R. Marak was simultaneously holding two crucial posts of Judge of the District Council Court and Secretary to the Executive Committee of the GHADC since August 2023.
The Court described this dual role as “alarming” and in clear violation of the constitutional separation of powers between the judiciary and the executive.
