HC quashes attempted murder charge after amicable settlement

SHILLONG, March 17: The High Court of Meghalaya has quashed an FIR against one Bimlan Sohshang after the petitioner and the complainant reached an amicable settlement.
Chief Justice of High Court of Meghalaya, Justice Revati Mohite Dere, passed the order regarding FIR No. 13(08) 2021, registered at Mawkyrwat Women Police Station under sections 307 (attempt to murder), 326 (causing grievous hurt), 354, 511 and 506 of the IPC.
The complainant had submitted an affidavit stating that the dispute had been resolved and that she had no objection to the proceedings being dropped.
The case reportedly stemmed from a relationship dispute where the complainant alleged the petitioner threatened her with a knife. While examining the records, the court, after noting that medical reports indicated only minor injuries, concluded that the more serious charges under sections 307 and 326 IPC were not supported by evidence.
The court observed that while section 307 is generally non-compoundable, quashing is permissible if the record does not justify the charge.
The court allowed the petition, quashing the FIR and the related case pending before the Chief Judicial Magistrate, Mawkyrwat.
However, the petitioner was directed to deposit Rs 25,000 into the complainant’s account within four weeks.
The matter has been listed for compliance on April 14.
