SHILLONG, June 29: The state government suffered a major setback in the High Court of Meghalaya on Monday after the court upheld a lower court’s order granting bail to Sonam Raghuvanshi in the Raja Raghuvanshi murder case.
Following the setback, the state government is preparing to challenge the High Court’s judgment before the apex court.
A single bench of Justice Wanlura Diengdoh on Monday dismissed the state’s petition challenging the bail granted by the Shillong Sessions Court. The state had invoked its inherent powers under Section 482 of the CrPC seeking cancellation of the bail.
The High Court rejected the plea, though its detailed order is yet to be officially released.
Sonam was granted bail by the Sessions Court after it found serious procedural lapses in her arrest. The court observed that the police failed to properly inform her of the grounds of arrest as required under Article 22 of the Constitution.
