Custodial death victim’s mother moves court
SHILLONG: The High Court of Meghalaya has directed the State Government to file an affidavit within four weeks time in connection with the custodial death of a 20-year-old youth Balsan Marak last month.
Admitting a petition filed by the mother of Balsan — Mina S Marak– on Wednesday, a division bench comprising Chief Justice PC Pant and Justice TNK Singh also issued notices to four people — West Garo Hills SP Mukesh Singh, other senior police officials Bruno Marak, CP Marak and Mukesh Singh’s PSO Govind.
The bench also issued an interim order directing West Garo Hills Deputy Commissioner to provide the copy of the post-mortem report and the death certificate to Balsan’s mother. Balsan died in judicial custody on May 20.
In his submission, the advocate of Balsan’s mother Sujit Dey stated that the district administration had refused to provide the copy of the post-mortem report and the death certificate even despite several requests made by his client.
In the petition, the mother of the deceased pleaded before the court to direct the State government to order a CBI inquiry into the circumstances that led to the death of her son.
Marak stated that the CBI should be given specific term of reference to investigate the matter. Seeking a compensation of Rs 21 lakh from Government, she in the petition also urged the court to order a fresh post-mortem on her son to be conducted by the Board of Central government doctors.
