SC returns case to Munsiff Court

SHILLONG: The dispute between businessmen Abdul Muquit and Rajesh Kumar Agarwala over a shop at Glory’s Plaza, Khyndailad, has reached the Supreme Court of India.

The apex court, while disposing of the Special Leave Petition filed by Abdul Muquit on August 11, directed the Learned Court of Munsiff, Shillong, to conclude the trial as expeditiously as possible and preferably within a period of one year and further directed the parties to implement the Status Quo order strictly.

Agarwala had challenged the order passed by the Court of Munsiff, Shillong, before the High Court of Meghalaya.

Chief Justice Prafulla C. Pant of the High Court of Meghalaya vide his judgment on July 1 set aside the order of the trial court and directed the parties to maintain status quo.

However, it directed that the shop (NO.DF2) in dispute and locked by the police should be opened and handed over to Agarwala.

In view of the decision of the Supreme Court of India, the parties have to implement the status quo as granted by the High Court till the Court of Munsiff, Shillong, adjudicates the case finally.
