CBI submits documents seized from MUDA to HC

Violation of building norms by 12 owners of high rises in Shillong

SHILLONG: The CBI on Friday submitted to the High Court of Meghalaya seized documents from Meghalaya Urban Development Authority (MUDA) related to the violation of building norms by 12 owners of high-rise building.

The CBI after seizing the documents from MUDA submitted the papers to the Court on Friday as per its direction a week ago.

Moreover, while nine alleged violators have filed their affidavits before the Court, two are yet to file their response, while another will have to file a fresh affidavit as the first affidavit filed was not found to be in order.

The alleged violators are Narayan Prasad Jhunjhunwala at Police Bazaar, Nilesh Tibrewalla at Thana Road, Satyabrato Baidya at Jail Road, Ajit Das Gupta at Jail Road, Bidur Das at Jail Road, Uday N. Shukla at Oakland Road, Rajkumari Sinha at Bivar Road, Mentok Ri-Project Pvt. Ltd at Bivar Road, Maruf Elahi at Bivar Road, Beroline Khongshei at Laban, Mohendro Rapsang at Keating Road and Saini Pala at Motinagar.

Earlier, MUDA was directed by the Court not to issue completion and occupancy certificates to these builders. The Court also wanted the alleged violators not to sell their flats in the twelve buildings to any intended purchasers by concealing the facts.

It was on November 28 that the High Court directed the CBI to seize all the documents pertaining to granting of permission by MUDA to the owners of as many as 12 high-rise buildings of the city.

The action of the High Court was in response to a PIL filed by city-based lawyer Jonathan Thangkhiew.

The High Court in an interim order on April 11 had prohibited constructions beyond G-plus three (ground floor and three additional floors) in Shillong following the violation of the building rules framed by MUDA.

Subsequently, the High Court formed a committee to examine the cases of violation of the Meghalaya Building Byelaws, 2011, in under-construction buildings. It was based on the report of the committee that further action was initiated by the Court.
