High Court cautions District Council judge

SHILLONG: The High Court of Meghalaya has cautioned District Council Court Judge, S. Kharsyiemlieh to remain transparent while passing orders in future, failing which necessary action shall follow. The caution was issued to the judge of District Council Court, Shillong by Justice SR Sen in his judgment over a petition filed by one Kabita Surong.
During the hearing, counsel for the petitioner, M F Qureshi submitted that the instant petition was initiated to cancel the bail order passed by the District Council Court dated February 4, 2016 as the opposite party had procured the pre-arrest bail from the District Council violating the condition of the bail.
On the other hand, counsel for the respondent, H Nongkhlaw submitted that he had not violated any condition of the bail order.
The lower court record was received and Qureshi also submitted that before granting the pre-arrest bail, he had made an objection and informed the District Council Court that the matter was pending before the High Court but the same was not taken into account.
However, Qureshi could not produce any FIR pertaining to violation of any condition of the Court’s order by the opposite party.
Justice Sen observed that it was not clear whether the opposite party had violated (any condition of the bail order and the opposite party was cautioned that he should abide by the condition of the bail order passed by the District Council dated 04-02-2016.
Further, he was directed not to disturb or threaten the petitioner in any manner and not to interfere with the investigation or tamper any evidence and he shall be bound to appear before the trial as and when necessary.
