HC directs SP to register pending FIR on assault case

SHILLONG: The High Court of Meghalaya on Thursday asked the Superintendent of Police, East Khasi Hills, and the officer-in-charge of Cantonment Police Beat House to register an FIR against the assault of a city based businessman whose complaint has not been acted upon by the SP (City) since January this year.
The petitioner Gajendra Singh, a businessman, through his counsel informed the Court that he was threatened by the Officer-in-charge of Cantonment Police Beat House, P.C. Sangma, and another constable to leave Shillong on January 12 this year after he was summoned to the beat house. The petitioner was also assaulted by an individual identified as Shankar Gupta at the same time.
The incident took place when they were drinking inside the police station.
According to P. Nongbri, counsel for the petitioner, inspite of filing the FIR with the Superintendent of Police (City), East Khasi Hills, the same has not been registered nor any investigation conducted. Hence, the petition was filed before the High Court.
Earlier, the petitioner said the OC has been repeatedly calling him from the police station stating that someone had lodged a complaint against him and also directed him to report to the police station. But when the petitioner appeared before the police beat house, the OC did not disclose the cause of the complaint, but detained him in the beat house for 2-3 hours.
On January 12 this year at about 8:30 PM, the OC again directed the petitioner to report to the police station. When the petitioner reached the police station, the OC asked him to sit with him in the other room in the police station where respondent Gupta was present.
According to the petition, both the OC and Gupta forced the petitioner to drink alcohol      as they were also engaged in drinking.
Thereafter without any reason Gupta assaulted the petitioner leading to his injuries. The petitioner was also threatened by one constable and the OC that if he does not leave Shillong, he would face dire consequences.
The next day the petitioner went for a medical examination at the Shillong Civil Hospital for injuries and the following day, he lodged an FIR in the office of the SP against the OC and Gupta.
The FIR pointed out the continuous harassment of the OC and the physical injury which was inflicted on him by Gupta. The petitioner had also urged the SP to enable him and his family to live peacefully without any harassment from them.
