SHILLONG: The charge sheet filed against 26 accused persons, who assaulted social activists Agnes Kharshiing and Amita Sangma on November 8 last year, has revealed that their presence at Tuber Sohshrie was established by analysing the data of mobile tower location.
The investigation officer has sent all the accused for trial after establishing their involvement in the case.
The charge sheet said analysis of the data of mobile tower location of the accused persons showed their locations were closely similar to those of the victims during the hours when the incident took place for which “it may be reasoned out that the accused persons were present at the place of occurrence and may have committed the crime”, the charge sheet said.
According to the charge sheet, under no circumstances, all the accused persons will coincidentally gather together in one place on the same day and at the same time and ‘also under no circumstances the victims will receive grievous injuries if not beaten by all the accused persons present there.
Illegal coal business
The charge sheet also said “it is a fact that all the accused persons are directly or indirectly engaged in coal business and coal activities which are illegal as coal mining activities were banned by NGT but the accused persons continued with illegal coal business and hence knowing the fact that the acts done by both the victims may hinder their business and may
be brought under the purview of law, the accused persons committed the crime upon the victims in order to prevent the victims from disclosing their illegal activities”.
Four evade arrest
The charge sheet said during further investigation, the accused persons, Defender Pakem, Poimi Sana, Wanmi Dkhar and Kiri Phawa, knowing that they had committed the offence, evaded arrest by absconding in order to escape from the law.
The probe report also said the fact that the accused persons, Janki Pakem, Phaimi Suchiang, Samtur Shylla, Git Bahadur Thapa, Kamwawanmi Dkhar, Kamai Chyrmang and Rock Simpli appeared before the court and sought pre-arrest bail, indicates that they are involved in the case beyond doubt.
Attempt to murder
On completion of the investigation and on analysing all the facts collected during the course of investigation, the investigation officer found a prima facie case under IPC sections 307 ( attempt to murder), 392 ( robbery), 326 (voluntarily causing grievous hurt by dangerous weapons) and 34 (Acts done by several persons in furtherance of common intention) against all the 26 accused persons.

HC case
The High Court of Meghalaya on Friday deferred the decision on the plea of the petitioner Agnes Kharshiing to transfer the case from Khliehriat to Shillong. During the hearing, Advocate General Amit Kumar pointed out that the accused against whom charge sheet has been filed have not been made as party respondents, and hence he sought a week,s time to file detailed objections.The petitioner can also implead the accused as respondents by laying a proper motion for the same. The matter will come up after a week.
