Rape accused granted interim bail to look after ailing family

New Delhi : The Delhi High Court has granted three weeks’ interim bail to a rape accused on the grounds that his kin needed medical attention.

Raushan Kumar Mishra, accused of raping a minor in 2018 in Delhi’s Adarsh Nagar area, who is facing trial under charges of rape and provisions of POCSO Act, approached the high court seeking interim bail on the ground that his family members, including his father, mother and wife, were unwell.

He also told the court that while his father had suffered a paralytic attack and required medical attention, his wife has been medically examined with complaint of fever and breathlessness.

During the course of hearing, Meenakshi Dahiya, appearing for the state, opposed the granting of interim bail to the petitioner. She, however, submitted that the medical documents with respect to the father of the petitioner have been verified.

After the conclusion of the arguments, a single judge bench of the high court presided over by Justice Manoj Kumar Ohri ruled, “Considering the facts and circumstances of the case and the medical attention required by the petitioner’s family, the petitioner is admitted to interim bail for a period of three weeks from the date of his release.”

The court also directed that Mishra should not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence.

“The petitioner shall provide his mobile number to the investigating officer, Virender Kumar Attri, and shall remain in touch with him on his mobile number on every Monday and Thursday during the period of his release on interim bail,” the court said, adding that Mishra shall not leave Delhi without prior permission.
