District council seeks notice on inter-tribe cases

SHILLONG, Nov 15: KHADC Chief Executive Member Titosstarwell Chyne on Tuesday said the council has written to the District Councils Affairs to issue a notification that cases between tribal people should remain with the district council courts.
“We want the trial of the cases involving tribals to be taken up by the district council courts,” Chyne said.
He said the government had issued a notification earlier stating that the district council courts will continue to derive their powers from para 4 and 5 of the Sixth Schedule of the Constitution of India.
The government made it clear about not diluting the powers of the district councils or interfering with the village courts or changing the procedure in the district council courts, he added.
The notification issued by the government reads: “In pursuance to the full separation of Judiciary from the Executive and in the exercise of the power conferred in the proviso to sub-section (2) of Section of the Code of Criminal Procedure 1973 (Act 2 of 1974), the Governor of Meghalaya is pleased to apply the provisions of the Code of Criminal Procedure, 1973, to the District Courts in the State of Meghalaya.”
