Shillong, June 28: Leader of Opposition in the KHADC, Titosstarwell Chyne on Wednesday has suggested the Executive Committee (EC) to challenge the recent order of the High Court of Meghalaya to allow the district courts of the state government to try cases between two tribals.
While taking part in the general discussion on the budget on the final day of the Council’s Summer Session, Chyne said that the order of the court was a setback to the council since the cases between two tribals used to be adjudicated by the district council court.
He also recalled that the state government had assured that there would be no infringement in the jurisdiction of the district council court while issuing a notification for extending the Code of Criminal Procedure, 1973 (CrPC) and the Code of Civil Procedure, 1908 (CCP) to all courts in the state.
It may be mentioned that the notification issued by the secretary in-charge of Law department said the “Governor is pleased to apply the provisions of the Code of Civil Procedure 1908 and provisions of the Code of Criminal Procedure, 1973 to the courts in the state of Meghalaya”.
The notification however, said the District Council Courts should continue to derive powers under paragraphs 4 and 5 of the Sixth Schedule to the Constitution of India.
In his reply, Deputy CEM, Pynshngain N. Syiem assured that the Executive Committee would pursue with the state government on the matter.
He also said that the EC would also consult the legal experts if they could appeal against the order of the High Court.
