EPFO announces six-month amnesty window for PF trusts

Shillong, July 11: The Employees’ Provident Fund Organisation (EPFO) has invited applications under the newly introduced Amnesty Scheme 2026, providing a six-month window for Provident Fund (PF) trusts to regularise their status and obtain retrospective exemption. The scheme follows amendments in the Finance Act 2026, which align the Income Tax framework for recognised provident funds with the EPF Act. Under the revised rules, recognition under the Income Tax Act is now only available to funds that have secured exemption under Section 17 of the EPF Act. The amnesty applies to establishments operating PF trusts recognised under the Income Tax Act, 1961, but lacking a formal exemption notification from the government. The scheme, which became effective on June 29, covers two categories: establishments seeking retrospective regularisation while complying as un-exempted units, and those continuing as exempted establishments under the Code on Social Security 2020. The EPFO also stated that pending proceedings regarding the assessment of dues, damages, and interest will be withdrawn, provided contributions and interest meet statutory rates. Any past finalised orders in such cases will be treated as void. Eligible employers must submit formal applications to the Central Government through their respective EPFO regional offices. Financial accounts must be audited by a chartered accountant, and any compliance audits ordered by the EPFO must be completed within three months of the application.
