High Court notice to MTC MD

SHILLONG: The High Court of Meghalaya has issued a notice to the MD of Meghalaya Transport Corporation (MTC), A Nikhla to show cause as to why contempt proceedings should not be initiated against her.
As many as five employees of the Corporation- Donsi Lyngdoh, Carmel Dhar, Dairo Singh Marngar, Jester Kharnaior and Jameson Rapsang, had filed a writ petition in the Court stating that their retiral dues had not been paid for long.
The Court had considered the writ petition on September 12 last and after taking note of the submissions made by the Government Advocate that the matter was under process, the Court had disposed of the writ petition with directions to the respondents to expedite the process and calculation of the retiral dues within five months.
The Court also left it to the petitioner to pursue the matter afresh in case the grievances were not addressed on time.
The petitioners filed a contempt petition in April stating that the retiral dues were yet to be paid.
Counsel, K. Khan submitted before the Court on Monday that the matter relating to the payment of gratuity and other retiral dues is pending with the State Government.
“It could hardly be appreciated that even after eight months from the date of the order passed by this Court, the petitioner is yet waiting to receive all his retiral dues; and even after giving a copy to the learned counsel for the Corporation before passing any order in the matter, it does not appear that the reasonable expediency has been shown,” the Court observed.
“If before the matter is taken up by the Court on the next date, all the retiral dues of the petitioner have not been paid, it shall be required of the respondent No. 1 (A Nikhla) to remain present in the Court,” the order added.
The matter will be put up for hearing after four months.
