HC stays KHADC direction

SHILLONG: Meghalaya High Court has stayed the cancellation of sanad to a petitioner, Phengly Mawtyllup by the KHADC.
The Court further issued notice to the KHADC.
The petitioner has challenged the order of July 21 as issued by the Executive Committee, KHADC, instructing the Syiem of Myriaw Syiemship to hold fresh elections for the office of Lyngdoh of Mawtyllup Clan.
Mawtyllup was elected as Lyngdoh in the Dorbar of Mawtyllup Clan, Myriaw Masar Umjakoit held on June 15, 2015 as the earlier Lyngdoh of Mawtyllup Clan expired. Thereafter, sanad was issued in his favour by the Syiem of Myriaw Syiemship on July 17, 2015.
The grievance of the petitioner is that after filing written arguments by him, the respondent – Executive Committee, KHADC proceeded to issue the July 21 order directing the Syiem concerned to hold the elections for the office of Lyngdoh and to cancel the sanad of the petitioner.
However, such an order was issued without stating any reason and without proper inquiry into the disputed questions.
