Lok Sabha to take up Justice Sen’s impeachment Sep 5
NEW DELHI:The Lok Sabha will Sep 5 take up impeachment proceedings against Justice Soumitra Sen.The Lok Sabha Secretariat has informed Justice Sen that the proceedings would be held on Sep 5-6 and he has to appear at 3 p.m. on the first day to present his case before the house. The Calcutta High Court judge will get two hours for the purpose.Creating history, Rajya Sabha had on Aug 18 approved the impeachment motion against Justice Sen. If the lower house passes motion to impeach him, Justice Sen could become the country’s first judge whose removal has been sought by parliament for misconduct.President Pratiba Patil would also have to approve the impeachment motion passed by both the houses.Justice Sen, then an advocate, was held guilty of misappropriating Rs 33.23 lakh in a 1983 case, while appointed a receiver by the high court.(IANS)
Delhi HC dismisses Kalmadi’s plea to attend Parliament
NEW DELHI: The Delhi high court on Tuesday dismissed the plea of sacked CWG Organising Committee chairman Suresh Kalmadi, a Lok Sabha MP, seeking permission to attend the ongoing Parliament session.”In view of the gravity of the offence and the allegation of huge magnitude, it would be totally inappropriate to grant him permission solely on the ground of freedom of speech inside the Parliament House, on the foundation that he has to meet the constitutional obligation. The writ petition is dismissed,” the bench, comprising Chief Justice Dipak Misra and Justice Sanjiv Khanna, said.The Congress Lok Sabha member from Pune had moved the division bench of the high court challenging the order of its single-judge bench of Justice Rajiv Sahai Endlaw, who had rejected his plea for the permission dubbing it as “an attempt to get fresh air outside the prison”.(PTI)
Sushma writes to Speaker, opposes extension
NEW DELHI: Raising objections to the one-year extension in tenure to Lok Sabha secretary general T K Vishwanathan, leader of opposition Sushma Swaraj has said he was “not fit” for the post.In a letter to Speaker Meira Kumar, Swaraj aired her objection, saying, “The conduct and behaviour of the present secretary general is not fit for the post.”Swaraj gave two more reasons for her objection to the extension given to Vishwanathan, who is a former law secretary.”You did not hold a formal meeting with the leader of opposition and leader of the House on extending the tenure of the present secretary general. Person can fight case through his agent in consumer court: SC
NEW DELHI:Hiring a lawyer is not mandatory for a person to fight his case in a consumer forum and he can plead his case personally or through his agent, the Supreme Court has said. A three-judge bench headed by Justice Dalveer Bhandari said that the Consumer Protection Act says clearly that a person can plead his case through his agent and it would be against the consumer to force him to hire the services of an advocate for his case. “The legislature has given an option to the parties before the consumer forums to either personally appear or be represented by an authorised agent or by an advocate, then the court would not be justified in taking away that option or interpreting the statute differently,” the bench also comprising Justices M K Sharma and Anil R Dave, said.
