State Govt awaits Parliament action on Amendment to Tenth Schedule

SHILLONG: The State Government has moved the Centre for implementation of the Anti Defection Law in the district councils.

Frequent defections by elected members of the district councils had resulted in the toppling of the administration in the councils on many occasions.

Parliamentary Affairs Minister Prestone Tynsong told reporters on Thursday that the State Government had written to the Union Ministry of Home Affairs in the middle of last year on the need to implement the Anti Defection Law in the district councils.

The process entails preparation of a cabinet memo by the Union Home Ministry for the consideration of the Union Cabinet.

After the Union Government approves the proposal, the matter will be taken up by the Parliament for Amendment to the Tenth Schedule of the Constitution to include the Autonomous District Councils under the purview of the Anti Defection Law, since existing provisions of the Tenth Schedule to the Constitution do not apply to the members of the autonomous district councils.

Earlier in March 16, 2011, the Meghalaya Assembly had passed a resolution to bring the district councils under the purview of the Anti Defection Law.
