HC orders probe against errant cop

SHILLONG: A sub-inspector posted at Sadar police station has faced the wrath of High Court of Meghalaya for beating up an accused, who was previously released on bail, after taking him out from a hospital where he was undergoing treatment.

The Judge SR Sen of High Court of Meghalaya in an order issued on Thursday said that the SP, East Khasi Hills should draw departmental proceedings against the police official identified as Jimmy Marak for the act. “If necessary, for the purpose of inquiry, he should be put under suspension”, the Court said.

The Court asked the SP to complete the inquiry within one month.

The accused, S Paul was granted bail by District and Session Judge on June 10, “but the previous Investigation Officer (IO) Jimmy Marak had dragged from the hospital and beat him mercilessly and produced before the court of Chief Judicial Magistrate (CJM) the next day where the accused revealed the plight and cruelty faced by him which is highly illegal”, the Court said.

Advocate K Paul appeared on behalf of the petitioner.

The Judge further asked “I could not understand that when the bail is granted by the District and Session Court on June 10, under what authority of law, the previous IO Jimmy Marak arrested the accused and produced before the Court of CJM on June 11”.

The Judge pointed out that from the observation of CJM, a woman police is also involved in the case, but her name could not be ascertained from the record.

“In my considered view, the previous IO Jimmy Marak has already stepped in within the parameter of contempt of court, but I am not drawing a contempt proceeding at this stage, but the SP East Khasi Hills is directed to draw proceeding against the erring officer”, the Judge.

The Judge hoped that the SP will make an impartial inquiry and will take necessary steps against the officer, if he is found guilty.
