EC to table Bill to regulate building constructions
Shillong: The two-day winter session of KHADC, scheduled to start from Tuesday, is likely to be stormy one as the Executive Committee is set to come up with United Khasi-Jaiñtia Hills District (Establishment of Town Committee) Third Amendment Bill, 2015.
“We have decided to table the amendment Bill which will allow the EC to regulate the building construction in areas where there is no town committee,” KHADC CEM Pynshngain N Syiem told reporters here on Monday.
“Once the House passes the Bill, it will be forwarded to the District Council Affairs department for the State Governor’s seal of approval,” he said.
When asked about KHADC Land Development and Building Regulation, 2015 which the State Government has declared it as “null and void”, he said that the EC was yet to pursue the matter with the State Government.
“We are not very sure if this notification for declaring the regulation as “null and void” has come from the Government or the Governor. We would have to first verify before proceeding ahead with the matter,” he added.
Referring to the United Khasi-Jaiñtia Hills District (Establishment of Town Committee) Acts 1960, he said that there is a provision in the Act which states that the building regulation in the areas falling under the Council should be done by the Town Committee.
“We had issued the Executive Committee (EC) order to amend Section 8 of United Khasi-Jaiñtia Hills District (Establishment of Town Committee) Acts 1960 which will empower the Executive Committee to implement the building regulation in places where the Town Committee is yet to be constituted,” the KHADC CEM said.
“We have passed the EC order per Rules 29 and 29 of the Assam and Meghalaya Autonomous Districts (Constitution of District Council) Rules, 1951. After the approval of the EC, we have sent this to the Director of Printing and Stationery department of State government to publish the matter in the Meghalaya Gazette. The request to publish the matter in the Meghalaya Gazette has been done as per paragraph 11 of the Sixth Schedule which states any rules and regulation passed by the Council can be sent for publication in the gazette,” he said. Meanwhile, the other issues which would be raised by the members during the two-day session includes issues on the need to have all categories situated along inter-State border to be surveyed and recorded by the council, on the need to find ways and means to improve the revenue of the Council and the amendment of the service rules of the Council.
