SHILLONG: The KHADC CEM P.N Syiem has urged the Meghalaya Governor V. Shanmuganathan to use his discretion and approve the name recommended by the council for the appointment of nominated member, while referring to the recent definition of the state government on the amended rule based on which the KHADC recommended the name of the retired District Council Judge J Reenboh.
A government source last week said that the sub rule 2 of the amended rule 6 of KHADC which states that “the district council may, if it so desires, recommend the name of persons for nominations”,  does not give absolute power to KHADC to recommend a nominated member.
The government banking on this, had justified the nomination of Irene Lyngdoh.
The Governor is yet to give approval to the names recommended by both KHADC and state government.
Reacting to the stand of the government on the amended rule, the KHADC chief said that it is the desire and interest of KHADC and not that of the state to recommend the name of Reenboh .
He also pointed out that as per article 160 of the constitution, the Governor should use his discretion independently to appoint the name suggested by the Council.
“The state government does not have any upper hand as the district council is an autonomous body. The KHADC took a conscious decision to recommend a person (Reenboh) with law background  and the government should know the mind of the Council that it did not recommend a person with political back ground”, Syiem said
