School principal, Education officials summoned
SHILLONG: Acting Chief Justice S.R. Sen on Monday came to the rescue of a student, who was asked by a city based school not to appear in the CBSE Class X Board examination 2016.
The High Court will take up the matter for hearing on Tuesday as it has summoned the Principal of the school and officials of the Education department.
The prompt action by the single bench of the High Court of Meghalaya was following a letter addressed to the Acting Chief Justice by the student identified as Shubham Prasad on Monday.
Prasad, a student of Class X in B.K. Bajoria Higher Secondary School said in the letter that he had appeared for the half-yearly examination in September and got very less marks.
Though the student requested for re-correction of his papers, no action was taken by the school.
“Now the school is saying that I cannot appear for CBSE Board exam and they are forcing me to appear for Home exam,” the student said.
According to the student, since he wanted to appear in the CBSE Board examination, the intervention of the Acting Chief Justice was sought.
During the hearing, senior counsel, T. Diengdoh and counsel, N. Mozika expressed their views that on humanitarian ground they were ready to help the student to get justice.
The Acting Chief Justice said that from the letter, it is clear that Shubham Prasad had expressed his desire for revaluation of his paper as he got less marks in the half-yearly examination, “but the school authority did not take any step on that point rather asked him not to appear in the CBSE Board Examination but to appear in the Home examination,” Justice Sen observed.
He further said that at the outset, “if any student feels that he has done better in the examination and got less marks, he could get revaluation and the authority is bound to do so”.
Hence, the High Court issued notices to the Principal, B.K. Bajoria School, as well as the Secretary, State Education department, and directed them to appear in person on Tuesday without fail as there is shortage of time since the Board examination is scheduled to be held from March 2.
