HC helps student to appear in CBSE exam

SHILLONG: The single bench of the High Court of Meghalaya has directed the Regional Officer of the Central Board of Secondary Education (CBSE), Guwahati to allow a Class X student of B.K. Bajoria School to sit for the CBSE examination scheduled to be held on March 2 under Scheme-2 without fail.
The High Court also asked the CBSE to submit the report within three days.
Earlier on Monday, taking a suo moto case, Acting Chief Justice S.R. Sen had directed the School Principal, Education and CBSE officials to be present in the court on Tuesday after the student, Shubham Prasad, wrote a letter to the Court stating that he was not being allowed to sit for the examination.
The student in the letter said that he had appeared for half-yearly examinations in September and had got very less marks and added that though he had requested for re-correction of paper, no action was taken by the school.
“Now the school is saying that I cannot appear for CBSE Board exam and they are forcing me to appear for Home examination,” the student had said.
As per the letter, since the student wanted to appear in CBSE      Board examination, the intervention of the Court was sought.
During the hearing on Tuesday, Principal of the school, B. Majaw as well as C.C.M. Mihsill, Secretary, Education, was present. The Regional Officer, CBSE was not present in spite of the notice being sent through fax.
Amicus Curiae, T.T. Diengdoh and N. Mozika were also present.
According to the Judge, the matter has been taken up on priority basis considering the fact the CBSE examination is scheduled to be held on March 2.
The principal of the School expressed her inability to help the petitioner to sit for the CBSE examination as it is beyond her control.
After hearing the submission advanced by the Senior Counsel as well as the Principal of the School, the Judge was of the prima facie view, that a student has got every right to choose his career provided he can perform and establish his capability.
“Since this petitioner being a student of Class X approached this Court and desires to sit for the CBSE examination instead of the Home examination called Scheme-1, I feel it is my duty to support his desire as he being a student and future citizen of the country”, the Judge observed.
The matter will come up for hearing after three days.
