Disqualification of MLAs act: HC calls for fresh petition

SHILLONG: The High Court of Meghalaya on Tuesday dismissed a petition questioning the validity of the Prevention of Disqualification (Members of the Legislative Assembly of Meghalaya) Amendment Act, 2015, with a liberty to the petitioner to file a fresh and properly constituted petition.
During the hearing of the petition filed by one Hardeep Ryntathiang of the NCP, the court said such arguments are sought to be advanced, which are not contained in the petition. It also questioned the frame of the petition where only the state of Meghalaya and the Khasi Hills Autonomous District Council have been arrayed as respondents.
Upon the court expressing reservations in entertaining the petition as framed, the counsel for the petitioner sought permission to withdraw with liberty to file a fresh and properly constituted petition. The counsel for the respondents had no objection and permission was granted. “This writ petition is dismissed as withdrawn with liberty as prayed,” the court order said.
