KHADC may challenge HC order on cases involving tribals

SHILLONG, June 28: The KHADC is likely to challenge a recent order of the High Court of Meghalaya allowing district courts of the state government to hear cases concerning two tribals.
Deputy CEM, PN Syiem said in the House on Wednesday that the executive committee (EC) will consult legal experts to understand if an appeal can be filed against the high court order.
Syiem said the EC will pursue the matter with the state government.
Raising the matter, Opposition Leader Titosstarwell Chyne asked the Executive Committee (EC) to challenge the order which is a setback for the council since cases between two tribals have always been heard and adjudicated by the district council court.
Chyne also recalled the state government’s “no infringement” assurance to the council while issuing a notification for extending the Code of Criminal Procedure, 1973 (CrPC) and the Code of Civil Procedure, 1908 (CPC) to all courts in the state.
The notification had made it clear that the district council courts would continue to derive powers under the Sixth Schedule to the Constitution.
