Assam yet to act on Langpih probe report

SHILLONG: Assam is yet to finalse the Action Taken Report (ATR) based on the report of the Justice (Retd) P.C. Phukan Commission, which probed Langpih incident of May 14, 2010.

Chief Minister Mukul Sangma informed this in the State Assembly on Monday while replying to a call attention notice of the HSPDP member Ardent Basaiawmoit.

In a written reply, Sangma said that the Assam Government had accepted the Justice (Retd) PC Phukan Commission. “However the same is yet to be placed in the Assembly as the ATR is under process,” Sangma said

The Chief Minister said that the copy of the report was made available to the State Government through the Counsel of the Gauhati High Court in September, 2012.

Sub-section (4) of section 3 of the Commission of Inquiry Act, 1952 stipulates that the appropriate Government “shall cause to be laid before each House of Parliament or, as the case may be, the Legislature of the State the report, if any, of the Commission on the inquiry made by the Commission under sub-section (1) together with a memorandum of the action taken thereon, within a period of six months of the submission of the report by the Commission to the appropriate Government.”

As per earlier media reports, the Commission had indicted Platoon Commander of Assam Police Prem Singh Limbu for ordering excessive and unjustified firing without a warning which claimed four lives. The Assam Government also informed that it was taking necessary action to provide financial assistance of Rs 5000 to Saraswati Mogor, whose tea stall was damaged in the firing. Financial assistance to eight injured persons at the rate paid by Meghalaya Government as per recommendation of the Commission will be paid by the Assam government.

Meghalaya Government had paid ex-gratia ranging from Rs 5,000 to 25,000 to eight injured persons, Everles K.Syiemlieh, Haiian Wahlang, Losping Nongphud, Pranding Snaitang, Strickbor Snar, Brimtarius Marthong ,Kolestar Jyrwa and Budsharsing Lyngkhoi

The State Government had already sanctioned ex-gratia grant of Rs 3 lakh each to

the widows of the four deceased persons. Assam had also paid the same amount to the widows of the victims.

Recently, the widows of the four victims also received another Rs 2 lakh each ex-gratia from Assam Government.
