NRI to contest specific performance case

SHILLONG: The non-resident Indian Tushar Bhattacharjee who is pursuing the case related to the recovery of property at Lachumiere from senior lawyer S P Mahanta, has said that the pending specific performance case filed by Mahanta long time ago will be contested by the former.
“I understand that following the dismissal of his (Mahanta) appeal in the Supreme Court, it has become irrelevant, and my advocates will file petition on the next date of hearing to dispose it”, Bhattacharjee said in an email sent from Sydney.
Bhattacharjee also claimed that he did not make any agreement to sell any property with Mahanta or his wife and did not want or receive any money from them.
“Neither did I sign any agreement to sell”, he said, while adding that Mahanta must have already stated all these during the trial.
According to the NRI, at the end of the day, what matters is that after considering all these, the District Judge  on May 6, 2013 had concluded that “the Appellants (we) are entitled to get back the possession of the said piece or parcel of land with the houses standing thereon.”
Bhattacharjee pointed out that Mahanta had appealed in the High Court of Meghalaya against the District Judge’s judgment, but the High court had rejected it.
