Deficit college staff should be included in NPS, state tells HC

SHILLONG, May 31: The state government on Wednesday told the High Court of Meghalaya that a notification, issued recently, provides that all employees of deficit colleges should be included in the new pension scheme (NPS) by converting the contributory provident fund contribution with effect from April 1, 2010.
During the hearing of a writ petition filed by Meghalaya College Teachers Association, the state government said that a notification has been issued on May 29 this year by the Education department in supersession of a pervious notification of April 13, 2018.
The notification provides that all employees of deficit colleges should be included in the new pension scheme by converting the contributory provident fund contribution with effect from April 1, 2010. “Accordingly, the employers are required to provide NPS facilities to the employees failing which the employers will be held responsible,” state told the court said.
A second, more important, notification was also issued on May 29 2023 pertaining to non-government school and college employees appointed to sanctioned posts who joined regular service prior to April 1, 2010, it said.
The Meghalaya College Teachers Association, however, said that the second notification covers the area of dispute involved in these proceedings.
The court said that the matter would appear a fortnight hence for the association to respond.
